Sounds like he knowingly sold you a lemon and didn't think twice about it. If there are no signs of drop/shock damage or water/element damage then you would assume that you can't usually break a DSLR by simply looking at it. Unless he showed you the camera, lenses, operation and example photos in proper working order prior to the sale then he doesn't really have a leg to stand on.

Stick with the D3200 and don't think twice. I have the D3100 and its a great starter. The D3200 can only be better!
