Picture Ownership Rights

Hi all.
I recently sold a classic car using a public car related forum. Within 3 weeks the car has now appeared for sale again on ebay.
My question here is with regards to the pictures the seller has used. He's blatantly and without my permission used all my original pictures to re-sell the car at a greatly inflated price.

Do I have any rights to those images?

Ebay will kill the auction for improper/unauthorized use of images or web pages -- it happens to me several times a month. File a complaint.

Thanks for the quick reply Wev.
I emailed the seller tonight and he's just now replied.
Says they're not all my photos (he's added 2 to my 7) and he's changed the text slightly (very slightly indeed).
Says he did it for ease but to me it doesn't excuse the £2000 mark up on his reserve price. With that going on I can't sympathise with his want of "ease".
There's 6 days to go and if the ad continues to run I'm likely to follow your advice. My photos are exactly that. As much as I love to show them to others I'll be darned if someone makes a rediculous profit at my expense by ripping them off.

Why are you upset that he's selling it for higher price, surely that's his his right unless he stole it. Why didn't you sell it for the higher price? I'm not being funny but I can't see what is wrong there.

As for the pics he probably should have asked if he wanted to use them or used his own. Without seeing the pictures it's hard to gauge the crime. If the are fantastic professional images that have been artistically lit with off camera lights it sets a different context to some snaps on a driveway. I know this doesn't alter the legal position but it may affect the anger level.

It makes no difference what the quality of the images may be or how easy it was to use them. He has no right to do so and it is explicitly against ebay rules to have done so. Give him 15 minutes to remove them or you will have the auction ended.

I had one person use my silver images/information, copying the entire web page they were on. The third time he did this, rather than kill the auction, I did a quick change of the images to some rather explicit porn -- the fool hadn't bothered to actually copy the images, just used the links to my pages. After several people reported the display, he was banned form ebay altogether.

The profit made (if he does make a sale) is another matter entirely; you may not like it, but that is the nature of commerce.

I can understand you're being upset that he is using your images to sell the car, but I just don't get being upset at what he's asking for it.:indecisiveness:

You have legal rights to your photos but I'm guessing it might be fair to say good luck trying to get your legal rights. eBay may take down the ad and tell him to use his own photos if you push it but really it's a case of if it is worth the bother to chase it up otherwise.

It's a nice car you sold :D
