Is this guy for real or not?

I just googled some and a guy asking how to change his email doesn't jibe with the grand picture he paints in that email.

The site is created Feb 2014.

Thats a difficult one,first thoughts are if its a well established and successful agency he wouldn't be chasing for contributers but instead would be turning them away,in this crazy world though you never know, my thoughts are follow it up and find out exactly what he is talking about before discounting it completely.

There is no harm in correspondence. Just make sure that you get paid for your contribution(s) (a rather difficult proposition if he is bent on cheating).

This is his agreement, I will be changing the 6 month payment thing.

LETTER OF AGREEMENT


This agreement is made between MEDIA DRUM, registered address 19 Lordswood Square, Birmingham B17 9BS and SCOTT MURRAY of <YOUR ADDRESS>.

SCOTT MURRAY gives MEDIA DRUM the right to exclusively license publication of any reportage supplied by SCOTT MURRAY ‏to MEDIA DRUM within the territory of the United Kingdom and also exclusively worldwide.

SCOTT MURRAY retains all copyright for material supplied to MEDIA DRUM.

MEDIA DRUM will retain 50% of all gross sales of said material, and will pay the remaining 50% to SCOTT MURRAY ‏unless otherwise pre-agreed by both parties.

In any month where monies have been received as a result of SCOTT MURRAY‏ reportage, MEDIA DRUM will provide a sales report, which will detail all sales of ‏ SCOTT MURRAY material where payment has been received from a client.

MEDIA DRUM will pay within 30 days of receiving international fees from clients for the amount recorded on a sales report and processed via cheque or bank transfer on the last Friday of that month. Both parties understand the UK this generally takes under three months and overseas under six months.

SCOTT MURRAY‏ will inform MEDIA DRUM in writing of any legal or sales restrictions other than those outlined above in relation to material supplied to MEDIA DRUM.

This agreement is valid from 30[SUP]TH[/SUP] March 2015 until terminated in writing by either party.

here are few points that you may want to consider :
. If they want 50% of the proceeds, they should pay on delivery, at least that is how consultancy agreements work here.
. Their right to your material is UK and world wide. I would suggest a better wording so that you retain some control (rights)

This is very badly drafted and sounds a bit vague. If it means that the tenure of agreement, it should be stated plainly. If it means payment, even then it should be rephrased.

. Please insert a paragraph for the jurisdiction of the agreement and the country/city for settling disputes. If it is in UK, then you will have a tough time and spend a lot of money on lawyers.

I have gotten some clarification from this company and have decided that I do not have anything to lose. I will be sending them 15'ish hi-res copies and see what happens from there. There is an option to terminate the agreement at any time and then they cannot use the photos. Also they only use for publications, not for frames etc. Fingers crossed this does not bite me in the arse. But in all reality I do this for fun so what have I got to lose?

If you have no qualms, go for it. At the most you will not get paid for them.

Go for it Scott. If the deal eventually turns out sour, you can just stop sending them your stuff. I don't see how you could loose.

Hi all! I'm new to this forum but have be a committed Nikon user for many years (a D5100 at the moment but looking to upgrade soon).

I found this thread when Googling Michael Carroll Media Drum, because I have received a similar approach and contract.

Can I ask how anyone's experience with Media Drum went please?

They have changed the payment terms to 30 days, and seem to have several new members of staff, looking at their website and correspondence.

Ive had one bad experience with a different media agency, but this lot seem ok so far. Did anyone do ok or have any problems with them please?

Thanks JH Foto, I definitely won't!

I'm leaning towards 'giving it a go for a few weeks and see what happens', at the moment unless I hear any horror stories.

A different agency once kindly(!) offered me a deal of '0% to you, 100% to us' for selling my project to news agencies/publications etc, so 50/50 seems like a bit of a step up in terms!

Seems like little to lose for me, maybe some publicity and a few quid would be a nice bonus. They seem a lot more open about stuff than some other companies... So far!
