NOW that it is returned to you, it is time to go through the process yet again. Take a new photo which shows the spots STILL exist and upload it. They go by the EXIF data so make sure it is a photo taken since it's been back and see what they say. I didn't think they would opt to issue a refund while the camera was in for its 3rd repair.
